1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and StudyPal ("we," "our," or "us") governing your access to and use of the StudyPal application and website (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
3. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the right, authority, and capacity to enter into these Terms.
4. Account Registration
To access certain features of the Service, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your account.
5. User Content
Our Service allows you to create, upload, post, send, receive, and store content, including messages, text, photos, and other materials (collectively, "User Content"). You retain all rights in and to your User Content, and you grant us a non-exclusive, royalty-free, worldwide, fully paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content in all media formats and channels now known or later developed.
You represent and warrant that you own or have the necessary rights to your User Content and that your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights.
6. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law
- Violate or encourage others to violate the rights of third parties, including intellectual property rights
- Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate
- Interfere with security-related features of the Service
- Interfere with the operation of the Service or any user's enjoyment of the Service
- Use any robot, spider, crawler, scraper, or other automated means to access the Service
- Attempt to circumvent any technological measure implemented by us to protect the Service
- Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Service
7. Intellectual Property Rights
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of StudyPal and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
9. Limitation of Liability
In no event shall StudyPal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
